ARTICLE I. Name

The name of this Local shall be NATCA Local Engineers and Architects, Eastern (EEA), constituting a Local of the National Air Traffic Controllers Association.

ARTICLE II. Objectives

The objectives of this Local shall be:

  1. To enhance working conditions for Engineers and Architects within the Eastern Region, the United States, its territories and possessions, and to represents its members in dealing with the Department of Transportation/Federal Aviation Administration and practices, and other matters;
  2. To enhance the safety of air traffic movement within the air traffic control jurisdiction of the United States, its territories and possessions through effective and efficient engineering of NAS facilities, systems and equipment;
  3. To preserve, promote and improve the professionalism and competence of air traffic system engineers and other aviation-safety-related employees, and by utilizing the members engineering expertise to incorporate state-of-the-art developments and technical innovation into the NAS;
  4. To design, improve and implement NAS systems and infrastructure so as to maximize the reliability, availability and maintainability of its components. To preserve, promote and maintain the best interests of the United States of America and particularly her leadership role in the aviation community;
  5. To preserve, promote and improve the rights of its members through all lawful means, including collective bargaining, political action, and contributing to such civic and charitable organizations as the Local Executive Board deems in the best interests of the Association;
  6. To provide the opportunity to reinstate any engineering position and employee that was originally hired in an engineering series and then was subsequently converted into a non-engineering series by policy or mandate, and;
  7. To limit the number of contract engineering positions in the FAA in order to maintain a consistent level of design expertise and ensure engineering functions are performed by its members.

ARTICLE III. Membership

Section 1. Candidates for membership shall be admitted to membership subject to and in accordance with the applicable provisions of the National Constitution, and such rules as may be adopted by the National Executive Board.

Section 2. Membership in a Local shall be limited to those engineers and architects serving within that local’s area of jurisdiction.

Section 3. The members of this Local shall be entitled to all rights and privileges of local membership and shall be subject to such duties and responsibilities, including the payment of dues, as provided in the National Constitution or as may be established by the Local. Only members in good standing of a local may serve as officers of the Local.

ARTICLE IV. Structure of Local

Section 1. The officers of this Local shall be President, Vice President for ANI-200, Vice President for AEA-400, Secretary, and Treasurer. At the option of the Local, the offices of Secretary and Treasurer may be combined into one position.

Section 2. There shall be an Executive Board consisting of the President, Vice Presidents, Secretary, and Treasurer.

ARTICLE V. Committees

Section 1. At the option of the Local, the following committees may be established:

  1. Safety Committee
  2. Communications Committee
  3. Balloting Committee
  4. Legislative Action Committee
  5. Finance Committee

Section 2. The President of the Local will appoint chairpersons of committees. The term of office for chairpersons of committees shall be one year.

Section 3. The President, as deemed necessary, may appoint special committees.

ARTICLE VI. Duties and Powers of Officers and Committees

Section 1. The President shall be the executive head of the Local. The President shall preside at all meetings of the Local. The President shall maintain contact with regional and national officers. The President shall countersign all checks drawn against the funds of the Local. The President shall oversee the functioning of all committees. The President shall brief new employees on the goals and functions of the Association, and shall provide them with membership information. The President shall attend all National Conventions as a primary delegate to represent the opinions of the Local.

Section 2. The Vice Presidents shall assist the President in the discharge of those duties. In the President’s absence, the Vice President for ANI-200 shall act in the President stead. If the Vice President for ANI-200 is unable to serve, Section 1 provides the order of succession. The Vice President shall perform other appropriate duties as assigned by the President or by the Local Executive Board.

Section 3. The Secretary shall keep a record of the proceedings of the Local, the attendance at meetings, and all matters of which a record may be deemed advisable. The Secretary shall make these records available for inspection at all reasonable times to any member.

The Secretary shall keep a list of names, addresses, and phone numbers of all members. The Secretary shall keep and file all documents, records and communications connected with the business of the Local. At the expiration of the secretaries’ term of office, the secretary shall turn over to the successor all documents and records pertaining to the office in this Local.

Section 4. The Treasurer shall keep a record of all financial transactions and be responsible to the President for all monetary matters pertaining to the Local. The Treasurer shall countersign all checks drawn against the funds of the Local. The Treasurer shall keep adequate records, which shall be available for inspection by any member at any reasonable time. The Treasurer performs other appropriate duties as assigned by the President. At the expiration of the Treasurer term of office, the Treasurer shall turn over all moneys, records, and documents pertaining to the office to the successor.

Section 5. The Executive Board shall exercise general supervision and control over the business, funds, and property of the Local. It shall have the authority to act in the name of the Local during intervals between meetings, such acts being subject to confirmation by the membership at the next regular meeting of the Local. It shall have regularly scheduled meetings. It shall have special meetings at the call of the President or on call signed by one-half or more of its members. A majority shall constitute a quorum.

Section 6. The Safety Committee studies safety in the workplace continually and shall make recommendations to Local, Regional and National Officers of NATCA, the Federal Aviation Administration, and other aviation organizations as necessary. It shall be the Local representative’s responsibility along with other Locals for planning improvement of procedures affecting the workplace environment.

Section 7. The Communications Committee shall prepare correspondence, reports, and documents at the direction of the President informing the membership of current policies and actions of NATCA and the Local. It shall assist other committees in preparing communications as requested, and other appropriate duties as assigned by the President. The publishing of a Local newsletter, if desired, will fall under the purview of the Communication Committee. The Communications Committee shall be responsible for establishing and maintaining a web site for the Local on the Internet.

Section 8. The Balloting Committee shall ensure that the membership is informed of all Local, Regional, and National issues to be decided by a vote of the membership. It shall draw up and distribute ballots when necessary, and tabulate the returns, which will then be given to the Local Executive Board for posting and distributing.

Section 9. The Legislative Action Committee shall act at all times in accordance with and in conformity with policies established by the National Executive Board. The committee shall take no action in opposition to or to the contrary of positions taken at the national level. It shall maintain contact with local Congressmen and Senators in order to keep them informed of issues of interest to the Local. It shall inform them of the Local’s position on pertinent legislation. It shall initiate letter writing and phone campaigns in support of, or in opposition to proposed legislation. It shall perform other appropriate duties as assigned by the President.

Section 10. If the Local chooses not to have any or all of the optional committees, the duties of these committees may be distributed at the discretion of the Local Executive Board.

Section 11. If the President or a Vice President is unavailable to attend the National Convention, the Secretary has next option to attend, followed by the Treasurer. If none of the above can attend, a vote of the membership will determine whom, of the general membership interested, will attend. The Local will absorb the necessary expenses of its representative at the National Convention. More than one representative from a Local may attend at the option of the Local.

Section 12. Officers and employees of the Local shall be bonded, if required by law, at the expense of the Local.

ARTICLE VII. Terms of Officers and Committees

Section 1. The President, Vice Presidents, Secretary, Treasurer and members of the Executive Board shall hold office for a two-year period, commencing the second Sunday of April. The only exception to this is the first year of the formation of the NATCA Engineers and Architects’ Association, which shall run until the first regular election. There shall be no restrictions on the number of terms that may be held.

Section 2. In the event of a vacancy in the office of the President, the Vice President for ANI-200 shall assume the office of the President until the next regular election. In the event of a vacancy in the office of a Vice President, Secretary, Treasurer, or member of the Executive Board, the Executive Board shall appoint a member to fill the vacancy until the next regular election.

ARTICLE VIII. Impeachment of Officers

Refer to the National Constitution for procedures regarding impeachment of Officers.

ARTICLE IX. Sanction of Members

Refer to the National Constitution for procedures regarding sanctioning of members.

ARTICLE X. Meetings

Section 1. There shall be a minimum of one regular meeting of the membership each quarter. Additional meetings may be called at the discretion of the President or on call signed by a majority of the members of the Executive Board.

Section 2. A minimum of fifteen (15) calendar days notice shall be given to the members of any regular meeting; provided however, that the President or the Executive Board, as provided in Section 1, may in emergency situation waive the fifteen calendar day notice requirements.

Section 3. A quorum shall consist of those members present at the meeting.

ARTICLE XI. Nominations and Elections

Section 1. Nominations for officers shall be made at the nominating meeting or at the regularly scheduled meeting in January of each odd year. The Balloting Committee shall present their recommended candidates for each office. Except the first year of the formation of the NATCA Engineers and Architects’ Association, which shall be in April 1998.

Section 2. The Balloting Committee shall accept nominations by the floor from members in good standing. No self-nominations shall be permitted. Write-in candidates shall not be permitted.

Section 3. The Balloting Committee shall determine the need for an election. An election shall be required only where two or more eligible candidates desire the same office. Any ineligible nominated candidate shall be so advised and offered the opportunity to defend their eligibility.

Section 4. Elections shall be conducted in accordance with regulations established by the Department of Labor. The winners of the election shall be the candidates receiving the majority of the votes. In the event no candidate receives a majority of the vote, a run off election shall be held.

Section 5. Election of officers shall be completed by March 31 of the election year. The Balloting Committee shall issue ballots by March 1 and close the ballot box at midnight on March 31. Ballots for elections shall be accepted via U.S. Mail only.

Section 6. All balloting shall be by secret ballot and in accordance with regulations established by the Department of Labor.

ARTICLE XII. Amendments

This Local Constitution may be amended upon direction by the Local Executive Board and ratified by 2/3 majority of members in good standing and/or in accordance with the provisions of the National Constitution.

ARTICLE XIII. Governing Rules

Section 1. In the event this Constitution is in conflict with the National Constitution; the National Constitution shall prevail.

Section 2. All regular and special meetings of the Local shall be governed by the National Constitution, by this Constitution, and by Robert’s Rules of Order where applicable.
